This working agreement must be reviewed by qualified healthcare and consumer-contract counsel before publication. Corporate identity, governing law, arbitration procedures, cancellation timing, refund rules, recurring-payment notices, clinical relationships, and vendor practices must be confirmed against Prime Point Health’s actual operations.
1. Acceptance and eligibility
These Terms of Service (“Terms”) are an agreement between you and Prime Point Health governing your access to and use of websites, forms, accounts, communications, scheduling tools, checkout experiences, and related online services that link to these Terms (collectively, the “Services”). References to “Prime Point Health,” “we,” “us,” or “our” mean the Prime Point Health operating entity identified in the final published version of these Terms.
By accessing the Services, creating an account, checking an acceptance box, or completing a purchase, you acknowledge that you have read and agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services.
You must be at least 18 years old, legally capable of entering into a contract, located in a United States jurisdiction where the requested Services are offered, and not prohibited by law from receiving them. Services may be unavailable or restricted based on your age, location, health information, provider licensure, product availability, or applicable law.
2. Prime Point Health services and provider relationships
Prime Point Health provides an online experience that may facilitate wellness education, account and intake administration, payment, scheduling, laboratory coordination, pharmacy coordination, fulfillment, and communication with licensed healthcare professionals or affiliated clinical organizations. The specific Services available to you depend on your location, the information you provide, and the offerings displayed at the time of use.
Prime Point Health itself does not make clinical decisions unless the final operating structure expressly provides otherwise. Professional medical services are rendered by appropriately licensed healthcare professionals or clinical entities. A treating provider is solely responsible for professional judgment, diagnosis, treatment recommendations, prescriptions, and the standard of care applicable to services the provider renders. Use of the general website alone does not create a provider-patient relationship.
You remain free to obtain care from another qualified professional. Prime Point Health does not guarantee that a particular provider, laboratory, pharmacy, product, medication, treatment format, appointment time, or service will be available.
3. Not for emergencies
The Services are not designed for medical emergencies or urgent medical conditions. If you believe you are experiencing an emergency, call 911 or seek immediate emergency care. Do not wait for a website response, account message, appointment, or provider review.
4. Telehealth, intake, and clinical review
Telehealth may involve electronic questionnaires, photographs, identity verification, secure messaging, video or audio visits, remote review of records, and coordination with laboratories or pharmacies. Telehealth has benefits and limitations, including possible technology failures, incomplete information, delays, privacy risks, and circumstances in which an in-person examination is more appropriate.
You agree to answer intake questions completely and truthfully, disclose relevant medical history, medications, allergies, symptoms, and changes in your health, and follow reasonable identity and location-verification requirements. Inaccurate or incomplete information may delay Services, affect a provider’s assessment, or result in denial or discontinuation of a requested service.
Submitting an intake, paying a consultation fee, selecting a treatment preference, or completing identity verification does not guarantee eligibility, a prescription, a particular care plan, or any result. Prescriptions are issued only when a licensed provider determines that they are clinically appropriate and legally permitted.
5. Accounts, credentials, and electronic communications
You agree to provide accurate, current, and complete account information and promptly update it when it changes. Account credentials are personal to you. You are responsible for keeping them confidential and for activity conducted through your account. Notify us promptly at (Input Prime point Email) if you suspect unauthorized access or another security issue.
You consent to receive electronic records and operational communications at the email address, telephone number, portal, or other channel you provide. These communications may include account verification, appointment reminders, intake requests, order or shipping updates, provider messages, receipts, security notices, and policy updates. Message and data rates may apply. You may opt out of promotional messages, but not communications reasonably necessary to administer requested Services.
6. Privacy and health information
Our Privacy Policy describes general information practices and is incorporated into these Terms. A licensed provider, clinical entity, laboratory, pharmacy, identity-verification service, payment processor, or other independent organization may provide additional terms or privacy notices that govern information within its systems.
Depending on the parties and information involved, certain health information may be subject to HIPAA or other health-privacy laws. The Privacy Policy does not replace a provider’s or clinical entity’s Notice of Privacy Practices.
7. Pricing, payments, and self-pay services
Prices, consultation fees, billing intervals, taxes, shipping charges, and other material purchase terms will be displayed before you authorize a transaction. Unless a checkout page expressly states otherwise, you are purchasing on a self-pay basis and are responsible for the full amount. Prime Point Health does not promise that an insurer, employer, health savings account, flexible spending account, or other third party will reimburse a charge.
You authorize Prime Point Health and its payment processors to charge the payment method you provide for transactions you approve and for any recurring service you affirmatively enroll in. You represent that the payment information is accurate, that you are authorized to use the payment method, and that sufficient funds or credit are available.
A consultation fee compensates for the consultation and related professional time identified at checkout. Unless expressly stated, it does not include medication, laboratory testing, shipping, or another separately priced service and does not guarantee that a provider will recommend or prescribe treatment.
Subscriptions and automatic renewal
If you enroll in a membership, subscription, or recurring treatment service, the checkout experience will disclose the amount and billing frequency before purchase. By completing that enrollment, you authorize recurring charges at the disclosed interval until cancellation. A subscription may renew at the then-current price after any notice required by law. The final production agreement and checkout must state the exact cancellation method, effective date, reminder practice, and treatment of unused benefits for each recurring offering.
Cancellations, refunds, and billing questions
Cancellation and refund eligibility may vary based on the service purchased, whether professional time has been reserved or used, whether a laboratory order or prescription has been processed, whether an item has shipped, and applicable law. The specific policy presented at checkout or for the applicable offering controls. Direct billing questions to (Input Prime point Email) so we can attempt to resolve them promptly. Nothing in these Terms limits non-waivable consumer rights.
8. Products, prescriptions, laboratories, and fulfillment
Product descriptions, images, estimated timelines, and availability are provided for convenience and may change. Prescription products require provider authorization and may be fulfilled by an independent pharmacy. Laboratory services may be performed by independent laboratories. Those organizations may apply their own terms, professional standards, privacy notices, and fulfillment policies.
You are responsible for providing an accurate, deliverable shipping address and for promptly reviewing deliveries. We do not ship to locations or address types excluded at checkout. Delivery dates are estimates, not guarantees. Risk of loss and title for non-prescription consumer products will be governed by the final sales policy and applicable law.
Do not share, resell, divert, or misuse a prescription or other restricted product. Follow the instructions of your provider and dispensing pharmacy. Contact the appropriate provider, pharmacy, laboratory, or support team regarding a suspected adverse event, damaged delivery, incorrect order, or other safety concern.
9. Acceptable use and intellectual property
We grant you a limited, personal, revocable, nonexclusive, nontransferable license to access and use the Services for lawful, noncommercial purposes consistent with these Terms. Prime Point Health and its licensors retain all rights in the Services, including site design, text, graphics, software, logos, trademarks, photographs, video, and other content.
You may not:
- use the Services for fraud, unlawful activity, impersonation, diversion, harassment, or infringement;
- submit false information or content you lack authority to provide;
- share account credentials or attempt to access another person’s account, health information, or payment information;
- probe, scan, disrupt, overload, circumvent, or interfere with security or authentication controls;
- introduce malware or use automated tools to scrape, copy, extract, or monitor the Services without written permission; or
- reproduce, sell, frame, reverse engineer, or commercially exploit the Services or their content except as permitted by law.
We may suspend or terminate access reasonably believed to violate these Terms, threaten safety or security, create legal risk, or interfere with the Services. Where practicable and appropriate, we may provide notice.
10. Information and content you submit
You retain ownership of content you submit. You grant Prime Point Health a limited right to host, process, reproduce, and transmit that content as reasonably necessary to provide, secure, and administer the Services and as described in the Privacy Policy.
Prime Point Health will not use an identifiable testimonial, review, photograph, or video for public marketing merely because it was submitted for care, identity verification, or support. Any public promotional use should be governed by a separate, clear authorization where required.
11. Third-party services and links
The Services may rely on or link to independent providers, clinical entities, laboratories, pharmacies, payment processors, identity-verification vendors, scheduling services, communications vendors, shipping carriers, and other third parties. Prime Point Health does not control independent third-party services. Your use of them may be governed by separate terms and privacy notices, and their availability may affect your experience.
12. Disclaimers and limitation of liability
To the fullest extent permitted by law, the non-clinical website and its general educational content are provided “as is” and “as available.” Prime Point Health does not warrant that the website will be uninterrupted, error-free, completely secure, or suitable for every purpose. General content is not a substitute for individualized advice from a qualified healthcare professional.
Health outcomes vary. Prime Point Health does not guarantee eligibility, diagnosis, treatment, a prescription, laboratory findings, weight change, symptom improvement, product availability, appointment timing, delivery timing, reimbursement, or any other result.
To the fullest extent permitted by law, Prime Point Health will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from use of or inability to use the non-clinical Services. Any aggregate monetary limitation, exclusion concerning independent clinical providers, or allocation of liability in the final Terms must be selected and approved by counsel based on Prime Point Health’s corporate and clinical structure. Some jurisdictions do not allow particular exclusions, so such limits may not apply to you.
13. Indemnification
To the extent permitted by law, you agree to be responsible for third-party claims, losses, or expenses arising from your unlawful misuse of the Services, material breach of these Terms, infringement of another person’s rights, or content you knowingly submit without authorization. The final scope, defense procedure, and exclusions for this provision require review by counsel before publication.
14. Informal resolution, governing law, and disputes
Before filing a formal claim, you and Prime Point Health agree to make a good-faith effort to resolve the issue by written notice to (Input Prime point Email). The notice should describe the issue and requested resolution. Nothing in this section prevents either party from seeking urgent relief where legally available or using a government complaint process.
Terms to be finalized before publication: governing law, venue, whether disputes will be resolved in court or through individual arbitration, the chosen arbitration administrator and rules, allocation of fees, small-claims rights, any class-action waiver, and any legally required opt-out process. No physical notice address is listed because Prime Point Health has not designated a public business location for this purpose.
These unresolved provisions should not be activated in checkout acceptance until counsel has confirmed the operating entity, jurisdiction, notice method, and consumer disclosures.
15. Changes, termination, and general terms
We may update these Terms as the Services or applicable requirements change. The revised Terms will be posted with a new “Last updated” date. Where required, we will provide additional notice or obtain acceptance before a material change applies.
We may modify, suspend, or discontinue non-clinical site features, subject to applicable law and obligations associated with a paid service. Termination does not eliminate payment obligations or provisions that by their nature should survive, including intellectual-property protections, disclaimers, limitations, dispute provisions, and obligations concerning prior conduct.
If a provision is found unenforceable, it will be limited to the minimum extent necessary and the remaining provisions will continue in effect. A failure to enforce a provision is not a waiver. You may not assign these Terms without written permission; Prime Point Health may assign them in connection with a lawful reorganization, financing, merger, or transfer of the relevant business, subject to applicable law.
